Terms and Conditions
1. Availability of Photographs
Photographs are offered for sale as limited editions of 5. The website is regularly changed to remove sold out prints and replace with new work. In the event of a print availability running out before it is removed from the site, a customer ordering it will be informed by email, given the chance to order a different size or another similar print. If this is not satisfactory a full refund will be made via the same method as used to place the order.
2. Order Confirmation
When you place an order with Compass Rose Photography you will receive one email confirming the order request. PayPal takes your payment before dispatch.
3. Delivery Method
As far as possible your order is dispatched within five working days after your order is received. (The photograph is printed and mounted when an order is placed). Occasionally the photographer Jenny Leathes is away on assignments lasting from a few days to a couple of weeks. If she is away every effort is made to check email and orders on a regular basis. You will be contacted as soon as possible if your order cannot be dispatched within five working days. Royal Mail is used; however we reserve the right to change the delivery method at our discretion.
4. Delivery Charges
Delivery charges are included in the quoted photograph and book prices for UK customers only. Additional charges are made for overseas orders.
5. Retention of Title
The title to the goods remain with the vendor until the goods are paid for in full.
6. Distance Selling
In accordance with the distance selling regulations the customer has the right to cancel the order within seven (7) working days of receipt of the order. The customer is expected to take good care of all items and not use them. Any goods not returned in the 'as new' condition may be refused or may involve extra cost in making the goods in the 'as new'. In order to meet the seven day deadline for cancellation, mailing or emailing the cancellation notice within that time frame is sufficient. Please, always refer to and include the order number. The cancellation must be put in writing using the contact page of this website. When returning non-faulty goods under the distance selling regulations delivery costs may not be refunded. Please note you have no rights under the distance selling regulations if you are a business customer. All refunds will be processed within 30 days of goods being received by to us.
7. Returns
We make every effort to ensure our products arrive in perfect condition. However if on arrival the product is damaged in any way, then customers must inform us, via the contact page on this website, immediately.
8. Payment Options
Various payment options can be chosen at the checkout stage, however all major credit cards and debit card are accepted. All payments for this site are processed using PayPal. For more information about PayPal please visit their site at http://www.paypal.com.
9. Refunds
Refunds for valid claims will be made via the same method of payment as used to place the order.
10. Data Protection
We only use personal information for the purpose for which it was provided and will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and secondly, to provide you with the best possible service.
11. Force Majeure
While every effort will be made to meet your requirements we shall not be liable for any breach of obligation resulting from causes beyond our reasonable control including but not limited to fires strikes (of its own or other employees) insurrection or riots embargoes container shortages wrecks or delays in transportation inability to obtain supplies and raw materials requirements or regulations of any civil or military authority (an 'Event of Force Majeure').
12. Complaints
If you have a complaint then please contact us immediately via the contact page of this website or by phone. All complaints will be acknowledged promptly and will be dealt with fairly and effectively. These terms and conditions don't affect your consumer statutory rights.
13. Errors and Omissions
WWe make every effort to ensure that all prices and on this website are correct and accurate. However, it is inevitable that mistakes will occasionally occur. In the case of a manifest error or omission, we will be entitled to rescind the contract, notwithstanding that we have already accepted the Customer's order and/or received payment from the Customer. Our liability in that event will be limited to the return of any money the Customer has paid in respect of the order. In the case of a manifest error in relation to price, the Customer will be entitled to purchase the goods by paying the difference between the quoted price and the correct price, as confirmed in writing by us after the manifest error has been discovered.
14. Privacy Policy
We consider issues relating to your privacy to be a serious matter. As such, we have created and implemented this Privacy Policy. We collect information about you in order that we can fill your order and only use personal information for the purpose for which it was provided and certain other activities, which are reasonably ancillary to such purpose. We do not sell your personal information to others, but we may use and disclose personal information that is relevant to a legal proceeding or as required by law. Other people's websites may have links on our site, if you link to their sites, they may collect information about you. Such sites are not within our control and are not covered by this privacy policy.
15. General
- The colours of photographs shown on this website are for guidance only as there may be colour variations due to the digitising process and variations in displays.
- Nothing in these terms and conditions affects your statutory rights as a consumer.
- If any provision in this Agreement is held to be invalid or unenforceable, it shall be deemed severed from the Agreement and this shall not affect the validity or enforceability of the remaining provisions.
- The headings are for convenience only and shall not affect the interpretation of this Agreement.
- We reserve the right to make changes to this document at any time. Please check back from time to time to ensure that you are aware of these changes.

16. The Law
These terms and conditions shall be governed by and construed in accordance with English law and you hereby agree to submit to the jurisdiction of the English courts.

All contents, property and software included on the website, such as photographs, text and graphics are the property of Compass Rose Photography and its associates, and is protected by United Kingdom and international copyright and database right laws.
You may not extract or use contents of the website without the express written consent of Compass Rose Photography.
All the Images displayed and for sale are copyrighted. All rights are owned by Compass Rose Photography. The user or purchaser of a photographic image from Compass Rose Photography may not reproduce an image in any traditional or electronic medium. Permission must be gained from the author Jenny Leathes of Compass Rose Photography if the image is to be used for purposes (other than personal display or storage) such as reproduction and public display.
Security
All credit card transactions from this site are processed using 128bit encryption.
Before being asked for your credit card information you will be transferred to a secure server, your browser will normally indicate this through the presence of a small yellow padlock, and the web address will begin with https:// instead of http://.
